When queried further your officer then states that he is ‘convinced he saw’ the offence being committed.
After further queries your officer then states that yes it did occur & was the driver.

As you will be aware I am innocent until proven guilty & as yet you have not offered any evidence to prove that this offence was committed at all,and you certainly will not have evidence that the offence was commited by myself,other than the word of your officer who,rather than give a full account immediately,is embellishing his statement every time he is questioned & still hasn’t fully described the event.

In view of this I would respectfully request that this fixed penalty notice is cancelled.

Right,thats the letter posted,I hope the guy does go sick,that means he wont be available to testify.
That last response has annoyed me,as it proves the guy hasnt taken any notes at the time,he is just giving the bog standard answer of driver & drivers window.
He still hasnt said how many people were in the car or given any sort of description of the driver,so they will be questions to put to him.

Of course that is the 'Piece de Resistance' of Groovy's case, when in the court he points out to the court that he doesn't even smoke!!
