“I categorically deny spitting on anyone and find the allegation made against me inaccurate. This is something I find abhorrent and simply would not do.

“There is no reaction by those in the vicinity where I spit, something which is supported by the video evidence.

“I would like to thank everyone connected with Hartlepool United for their support and I look forward to representing the Club again once my ban is complete.”

Chief Executive Russ Green added: “I am still astounded by the charge and the Club’s support remains fully with Carl.

“I know that doing something like that is not in Carl’s nature and it’s disappointing for him and for the Club that we will be without him for a period of time.

“He’s a committed professional though and there is no doubt that he will work hard in the coming weeks to ensure he remains in peak condition for when he is able to return.”



- He denies it
- Video evidence proves he didn't do it
- The club back him and are astounded by the charge

Yet they don't appeal it? What the hell is going on?

I can only assume that footage is from a distance and doesn't prove that he does or doesn't spit. It must be from distance as the crowds reaction has been mentioned a fair bit. The camera position at Wycombe is in the big stand opposite to where to tunnel and dugouts are which I'm again assuming is where the 'incident' took place.

So ultimately while the club are furious an appeal isn't worthwhile.

Law 12 says that 'spitting at a player or any other person' is a sending off offence. Presumably the FA have decided that if there are people in the vicinity of where you spit it counts as spitting at them in which case there is no point in appealing because he admits spitting near them. Sending off offence straight after being sent off is always going to be a big ban.

Does seem very harsh but if he spat into an area reserved for the crowd there was always a chance of it ending badly.

Does this not set a precedent where any fan can simply accuse a player of spitting and they face a 6 game ban?

Have pools ever got anything overturned by the FA on appeal. We'd be more likely to have another 3 matches slapped on the ban for being spurious.

I've e mailed the FA, our back four spat at me and that Boyce's was a full on greenie.

The Luton keeper spat on the floor around 30 yards away from me the other week, i've emailed the FA.

I have it on good authority that all of the Dagenham squad have at some point in time spat in a generally Northerly direction so I am just off to write a strongly worded email to the Football League

Someone sometime has got to challenge this all powerful decision making of the FA.

If what he says is true they must appeal. Should they lose the appeal then they should challenge it in a higher court. The High Court if necessary. I do not understand the legal basis that the FA have to fine people for fairly trivial offences.

I totally agree.
I can't understand the situation in football where clubs and players seem to refuse to take incidents "further". Surely there must be a clause somewhere, perhaps in the competition rules, that states that clubs or individual players are not allowed to take the FA to court and that any decision made by the FA is final, otherwise there would be a constant flow to the Courts.
In Magnay's case, if this was an individual accused by the Police, following a complaint by a member of the public and there was not sufficient evidence to back the complaint up, the incident would be thrown out.
This FA type justice harks back to the 18th century. If we still had penal colonies then the FA would be sending people there.
Everyone just meekly accepts anything handed down by the FA and then says " we have to move on", instead of standing up to these autocratic bastards.

As someone else said, maybe its just a case that appealing and using lawyers etc costs money and we dont have that money?
