Try getting one of those anti cat devices that emit a constant sound that drives cats mad. The moggie will clear off.

i would do some research first.....

we had a problem with a moggy......bought an electronic device and fitted it..... my doughter who's room lokked over the said garden couldn't sleep for the high pitched noise...........which noone else could hear.......
the cat kept using or garden...
a few days later the cats owner wass talking to the missus about her cat which turned out to be STONE DEAF............ rage

I can hear them devices from the bottom of the street if the breeze is in the right direction.
