right. I have a call from my wife whose colleague has just had a parking ticket off a private company called G24 in Peterlee. The ticket was issued in Aldi car park, apparently.

So I have advised her not to pay it and ignore any notices she gets.

What do the legally minded on here reckon?

The only tickets that you have to pay or challenge are those issues by the Police or Local Authority. All others are made to look like legal tickets but are only enforceable by taking the claim to court where they have to demonstrate loss. Its best not to make any contact with parking companies and ignore any letters that they send threatening court action/credit history etc. They will be a nuisance and will then go away.

Basically when you enter a car park you accept the terms of the contract. However, the you is the driver. The keeper of course may not be the driver and there is no legal obligation to provide the drivers details.

the other detail I should have mentioned is that the car in question is a lease car.

This used to be the case, but back in October 2012 they changed the rules and the registered keeper is now liable.

However there are still ways to avoid paying their stupid charge as its still just an invoice and they would still have to show that loss occurred.

Same company sent me a ticket for the same car park a year and a half or more ago when the wife parked there. I wrote and told them that I wasn't in Peterlee that day and could prove it. Never got a reply to my letter just loads of computer generated standard letters about how they were going to take me to court. At first they were every couple of weeks, slowed down to every couple of months after a while and last one was about October last year.

Still not got a court date from them.

Most courts wont accept a debt as a case if its under £100.

All the court stuff would have to go through a small claims court as its a civil not a criminal matter.

Most of these firms have the same address as the solicitor and debt collector they use. It's a big fucking scam that costs them a few £ to administer but if 1 in 100 pays up at any time they make a profit.

If you are bothered send a cheque for a couple of £ more than the parking fee would have been in 'full and final payment' and then ignore. The firms say they want £60 if you pay now or £120 if its later then add all kinds of stuff, the last one I got for the Marina says I owed the £250 for one ticket and £375 for another once they've made up some fees.
