Any prosecution would be a complete waste of taxpayer's money. Any brief would easily argue that a 78 yo confronted by two middle aged men in his own home in the early hours of the morning feared for his life and only used force in self defence.

I'm not sure he deserves a meddle. Maybe just a small fiddle would be about right.

I can't see what he's done wrong, the law allows you to defend yourself with 'reasonable' force. Stabbing some silly boy in your home who isn't supposed to be there is more than reasonable. He just has to argue he felt he life was threatened.

If it was found the burglar was stabbed as he was running away to get out of his house, the old man might be in trouble.

Defending yourself is one thing, picking up a knife to do it is another, especially if prior to it, you've been drinking Guinness all night

Balls to that.

You decide to enter my home whilst people I love are asleep in there and I'm maiming you - at minimum. Your injuries will be life changing if not life ending.

I don't care if you're running away; you regret it now; you're apologising or anything else.

It's God knows what time in the morning and I'm making sure you aren't given the chance to get back up.

And are you really saying the bloke was irresponsible because he'd had a bit to drink? So if I have a few whiskies before bed, I can defend my home because I'm intoxicated? My own home?

World has gone mad.

Thing is if someone is running away, the self defence argument doesn't quite work.

If they're in your house regardless of entering or exiting it then they are a threat.

The deceased was an habitual criminal with a record of preying on the old. Few will shed any tears!
The police have to go through the motions of investigation but it is the CPS that will decide if there is to be a trial.
If the CPS decide that a conviction is less than highly probable they will drop charges like a hot potato.

If he was running away......how the hell does a 78 year old catch you when you are running and you are 40 years younger?

If the guy defended himself on his own property, as seems to be the case, little chance he’ll be prosecuted. You only really get in trouble if you go and find a weapon and chase the scumbag down the road then knack him.

For once commonsense prevails in this pathetic, insignificant, PC-ridden nanny state.

I, for one, don't want to live in a world where it is ever acceptable to stab someone. What's to stop me from inviting PaulL to my house, stabbing him, then when Police show up just saying he was a burglar? It is completely right that he was arrested for the investigation, and released without charge when it was clear it was self defence.

Agree (almost entirely) - the guy should have been taken in for questioning but not arrested. He should now receive that medal or an OBE in recognition for his bravery. You can bet your life that the British athletes at the tin-pot Commonwealth Games will be recognised in this manner for bringing home lumps of metal at considerable expense.
