Apparently he wasn'y drunk but was fishing in the Northallerton area. Shame for the bloke really. He was driving without insurance.

If he wasn't drunk how has he been charged with drink driving?

Shame for the bloke? Not convinced you'd be saying that if he'd hit you, in a vehicle or not in a vehicle.
