Chip, im no solicitor but my wife was sacked at the end of 2006 and won her claim against the company. How long have you worked there? Have you been given any previous warnings? she ended up paying 480 quid in solicitors fees which i think was pretty good.

Chip I'm pretty certain you have a rather strong case here. I'll pass this on to my mate who is doing rather well for himself in London in the law department and see what he says.

But common sense says they have totally fooked up here.

was the use of the internet in their time or yours?
if you are always forgetting to log out of websites can they prove that it was you using the sites?
were the phone calls traceable to you ie were they to a phone line that only you had access to at any particular time?

Again sorry to hear about this....
We had a similar situation with a young lad in our office.....our IT did track his works e mail which he frequently wrote that "basically took the p.... when he was at work and he done F... all and got paid for doing nothing and evryone one around him were tossers etc etc....I was not involved in the disciplinary hearing but needless to say he resigned....this was not because he used MY space or face book etc etc (Yout IT bods can easilly block all those sites if they thought that was an issue.....It also prompted us to issue an internet policy which at the time we never had....i m certain you financialy would not sack someone for something that was never stated to be "not company policy"
This ,together with the letter on your desk,no consultaion etc etc is completly wrong and would never hold up if it went to court(IMO)....in fact thro exp....the judge i believe would instantlty look at the way the company handled the whole thing and would get no support from the judge....Im not saying that you will all keep your jobs but i believe you will stand a very good chance of compensation in some way.
We also moved from one town to another and we had to and still do reimburse all employers to travel the extra distance tho it did depend on how much it affected each individual and was agreed by all the montary value of this payment....
Im no empoyment law specialist but i do have 1st hand experience in these matters and to be honest it all sounds bad from the way your company has handled it all......
Hope it gets resolved...quickly

I almost got sacked of the same thing i was slagging the company on a fourm was suspended for 2 weeks then given a final warning, they also check myspace facebook etc to see if anyone has been slagging the company a few people have been given the boot for it.

Correct me if I'm wrong but they have zero proof that you wrote it. You are very bad at logging yourself out of computers so obviously someone has used the computer after you and played a prank on you. As a good employee you wouldn't dream of saying such things. It's impossible to prove that you actually wrote it.

It seems to me that your human rights have also been infringed. I'd be shocked if your contract of employment didn't give them the right to record phone calls and obviously internet usage long with it. A company internet cafe seems a grey area to me, it would need a specialised legal opinion.

Incidentally, any action that potentially causes redundancies must by law be subject to a 30 day consultation period. If it involved the possibility of redundancies of more than 100 people then that consultation must be 90 days. These consultations also must be meaningful.

They are perfectly within their rights to relocate the business but they must by law go through the correct process.

Finally, I'd be very careful what you write about this on here in fact if I were you I'd consider deleting whats already on here.

Fight it out but remember that the minute you admit that you scribed it, you're fooked.

As for getting another job; I don't think it will be a factor. Given that you have clearly performed well, after all they promoted you. The prime factor for interviewer is 'can he do the job better than another candidate?' As long as you are open and clear to a potential employer, explaining that your blog was hacked its not a real issue. Even if you resigned now these events would be reflected in any reference enquiry so you need to get your side of the story in first at interview.

There is the option of handing in your notice and later going back at them for constructive dismissal, but I'm not the expert and if you get the chance, talk to one about it.

Either way with your length of service its a big call to instantly dismiss you given that its perfectly possible that someone else wrote it. Even if you had then at worst I would have thought that a written warning is appropriate, possibly a first and final. Should they instantly dismiss you then its off to the tribunal.
